KUANTAN, July 18 — A man was fined RM6,000 by the Magistrate's Court today for knowingly submitting false information in an application for an identity card or MyKad.
Magistrate Tengku Eliana Tuan Kamaruzaman meted out the fine on Abdah Said, 65, after he pleaded guilty to the charge. He paid the fine.
The accused was charged with providing false information when applying for an identity card for a 12-year-old girl by using a birth certificate issued in the name of another child at a counter of the Pahang National Registration Department (JPA) at 9.49am on September 28, 2012.
The offence, under Regulation 25(1)(b) of the National Registration Regulations 1990 (Amendment 2007), provides a maximum jail term of three years or a fine not exceeding RM20,000 or both, if convicted.
The prosecution was handled by JPA Prosecuting Officer Mohammad Yusaini Yunan and Assistant Prosecuting Officer Burhanuddin Hamzah, while Abdah was unrepresented.
In mitigation, the accused pleaded for leniency, citing his unemployment.
However, Yusaini requested a severe and proportionate punishment, stressing the gravity of the offence, as the accused had used his own daughter's documents for personal gain.
He said the punishment should serve as a reminder to the accused and to the public not to hand over documents belonging to Malaysian citizens to foreigners, enabling them to enjoy privileges meant for Malaysians.
