Amendment to Syariah Enactments tabled to allow courts to manage cases online

SHAH ALAM, July 25 — State executive councillor for Islamic religious affairs Mohd Zawawi Ahmad Mughni has tabled the Islamic Religious Administration Enactment Bill (Selangor) (Amendment) 2022 in the State Legislative Assembly earlier today.

He said the amendment will empower Syariah courts to conduct case proceedings using remote technology.

When presenting the enactment, Mohd Zawawi said the Selangor Syariah Judicial Department (Jakess) is facing physical constraints over court proceedings due to the spread of Covid-19, which has resulted in delayed cases.

"The Islamic Religious Administration Enactment 2003 and mal procedures do not specifically empower Syariah courts to conduct proceedings including hearings, mentions, case management, councils, administration, wakalah and affidavits using remote technology.

"These amendments made to the existing law create a provision enabling Syariah courts to conduct case proceedings through remote technology," he said.

Earlier on, Mohd Zawawi informed the assembly the amendment to the Bill was approved during a meeting of the Selangor Islamic Religious Council (Mais) on January 25, to be presented to the Sultan of Selangor Sultan Sharafuddin Idris Shah Alhaj.

"The bill was presented and approved by the Sultan on April 7, in accordance with Subsection 22(5) of the Selangor State Islamic Religious Administration Enactment 2003. His Royal Highness agreed and approved for the bill to be presented in this current Assembly session," he said.
